Racism does not become harmless simply because no one admits racist intent.

When courts require proof of what someone privately meant before recognizing discrimination, they create a shield for systems that produce unequal outcomes. A policy can be written in neutral language, defended with polished arguments, and still place the heaviest burden on Black communities.

The real questions are: Who is harmed? Who loses access? Who loses protection? Who is pushed backward?

A definition of racism that ignores repeated racial harm does not defeat racism. It protects the system producing it.

Institutional racism rarely announces itself openly. It hides behind words such as “fairness,” “tradition,” “security,” “states’ rights,” “merit,” and “colorblindness.”

That is why outcomes matter.

When decisions weaken voting protections, restrict remedies for discrimination, erase the effects of past injustice, or make racial harm harder to challenge, Black America pays the price—whether the decision-makers confess their intent or deny it.

The absence of an admission is not proof of innocence. A system must be judged by what it repeatedly does to people, not only by what those in power claim they meant.

The Supreme Court holds enormous power, but the people who shape the Court reach that power through elections. Presidents nominate justices. Senators confirm them. Voters determine who holds those offices.

That is why Black America cannot surrender the vote.

We must vote in massive numbers—not because voting is our only tool, and not because any party deserves blind loyalty. We vote because courts, laws, public resources, civil rights, and access to justice are shaped by those who gain political power when we participate—or when we stay home.

We must organize, educate, vote, defend our rights, support Black-owned media and institutions, and hold every elected official accountable.

When institutional power is used against us, our answer must be organized power, economic power, and massive voting power.
